Understanding Surrogacy Types

Before jumping into the details of surrogacy laws, it's important to clarify the two main types of surrogacy: gestational and traditional.

Gestational (Host) surrogacy involves transferring an embryo created through in vitro fertilization (IVF) into the surrogate’s uterus. The surrogate has no genetic link to the child, as the embryo is created using the eggs and sperm of the intended parents or donors.

Traditional (Straight) surrogacy is different. Here, the surrogate uses her own eggs, making her the biological mother. This method raises unique legal and emotional considerations.

These distinctions are crucial, as they impact the legal rules throughout your surrogacy journey.

Key Factors to Consider

Start by investigating the legal status of surrogacy in the UK. Ask yourself:

  • What Surrogacy Organisations are available in the UK?

  • What clinic shall we use?

  • What type of Surrogacy works for us?

  • What are the surrogacy parental issues upon birth?

  • Have we all made Surrogacy Wills?

  • Have we all received implication counselling and legal advice?

  • Have you all signed a Surrogacy Agreement?

Consulting with a lawyer specialising in surrogacy law can simplify this process significantly, ensuring that everyone’s rights are protected and that you are informed about your options.

Parental Laws

In the UK, it is the Surrogate that would be registered on the child's birth certificate as the birth mother and if she is married, her spouse would be registered as the other parent at birth.

The Intended Parents would need to apply to the Family court post birth for a Parental Order to be made transferring parental rights from the Surrogate and her family to them.

Financial Considerations

Finances are a major aspect of surrogacy that demands careful planning. The total costs can range from £10,000 to £20,000, including medical costs, and surrogate expenses.

Many intended parents and surrogates opt for surrogacy organisations for guidance as they provide valuable resources and assistance at each step of the journey.

Post-Birth Considerations

After the baby arrives, legal steps are still necessary to ensure everything complies with the law. This may involve finalising parental rights and securing the birth certificate.

There is a timescale post birth to comply with the Court rules. Keeping your legal team engaged post-birth can expedite necessary paperwork and ensure compliance.
